1. Identification of the company
These Terms and Conditions govern the contractual relationship between:

(hereinafter referred to as "Ninho do Tejo" or "we")
and the customer who places an order through our site (hereinafter referred to as "customer" or "the customer").
2. Object
These Terms govern the distance sale of clothing, textile items and accessories for babies and children, available in our online shop.
3. Acceptance of the Terms
By placing an order on our site, the customer declares that they have read, understood and fully accepted these Terms and Conditions, as well as our Privacy Policy, Shipping Policy and Returns Policy.
4. Capacity to contract
Only natural persons aged 18 or over with full legal capacity to contract, or legal entities properly constituted and represented, may place orders.
5. Order process
Orders are placed through our site, via the following steps: selection of the items wished for and adding them to the basket, filling in the billing and delivery details, selection of the payment method, review and confirmation of the order, and finally the payment.
After receipt of the payment, the customer receives a confirmation email with the order number and the details of the purchase. This email constitutes formal acceptance of the order by Ninho do Tejo.
Ninho do Tejo reserves the right not to accept orders in which a clear pricing error, a stock-out not reflected on the site, signs of fraud, or any other situation justifying a reasoned refusal is detected. In such cases, the customer will be informed immediately, and any amount already paid will be refunded in full.
6. Prices and VAT
All prices shown on the site are in euros (€) and include Value Added Tax (VAT) at the legal rate in force in Mainland Portugal (23%, with exceptions for items subject to reduced rates).
Prices do not include the shipping cost, which is shown clearly at checkout, depending on the delivery address and the value of the basket.
Ninho do Tejo reserves the right to change prices at any time. The price in force at the moment the order is confirmed will, however, always apply.
7. Payment methods
We accept the following payment methods: MB WAY (processed by IFTHENPAY), Multibanco reference (processed by IFTHENPAY) and credit or debit card (Visa, Mastercard, processed by Shopify Payments).
All payments are processed in a secure and encrypted environment. Ninho do Tejo neither has access to nor stores credit or debit card data.
8. Invoicing
For each order, an invoice-receipt or invoice is issued in accordance with Portuguese tax law. The customer may request the inclusion of a tax number (NIF) on the invoice by filling in the corresponding field at checkout.
The invoice is sent electronically to the email provided at the time of purchase.
9. Delivery
The conditions of delivery (times, costs, areas covered) are described in detail in our Shipping Policy, which forms an integral part of these Terms.
10. Right of withdrawal (returns)
Under Portuguese Decree-Law 24/2014, of 14 February, the customer has the right to withdraw from the contract, without needing to give any reason, within 14 days from receipt of the items. Ninho do Tejo voluntarily extends this period to 30 days.

11. Legal guarantee
All items sold by Ninho do Tejo are covered by the legal guarantee of conformity, under Portuguese Decree-Law 84/2021. For movable goods, the guarantee lasts 3 years from the delivery of the goods.
In the case of lack of conformity, the customer must contact us at geral@ninhodotejo.pt within the legal time limit, describing the situation and enclosing, where possible, photographs or other relevant documentation.
12. Intellectual property
All content on the site ninhodotejo.pt — texts, images, logos, brand, graphic layout, product photographs — is the exclusive property of Ninho do Tejo, Lda. or of its partners, and is protected by the applicable legislation on copyright, registered trademarks and industrial property.
The "NINHO DO TEJO" brand is a registered trademark. Any reproduction, copying, distribution or commercial use of any content without prior written authorisation is expressly prohibited.
13. Limitation of liability
Ninho do Tejo undertakes to provide a diligent service of high quality. However, we are not liable for delays in delivery caused by the courier or by factors beyond our control (adverse weather conditions, strikes, force majeure), for damage resulting from incorrect use of items contrary to the manufacturer's instructions, or for the temporary unavailability of the site for technical or maintenance reasons.
14. Personal data
The processing of the customer's personal data is governed by our Privacy Policy, which forms an integral part of these Terms.
15. Dispute resolution
In the event of a dispute, the customer may turn to the following alternative dispute resolution bodies:

16. Applicable law and jurisdiction
These Terms and Conditions are governed by Portuguese law. For the resolution of any dispute arising from their interpretation or performance, the courts of the judicial district of Setúbal shall have exclusive jurisdiction, with express waiver of any other.
17. Changes to the Terms
Ninho do Tejo reserves the right to amend these Terms and Conditions at any time. Changes apply only to orders placed after their publication. The date of the last update is shown at the top of the document.
